The Client shall pay Locator Man Ltd the fees and expenses at the times and in the manner set out here.

Where this Agreement has been entered by an Agent (or a person purporting to act as Agent) on behalf of the Client, the Agent and Client will be jointly and severally liable for payment of all fees and expenses due to Locator Man Ltd under this Agreement.

All amounts payable by the Client shall be paid on the 20th day of the following month of the relevant invoice being mailed/emailed to the client. Late payment will constitute a default, and the Client shall pay default interest on overdue amounts from the date payment falls due to the date of payment at the rate of Locator Man Ltd bank overdraft rate plus 4% , and in addition the costs of any actions taken to recover the debt.

Locator Man Ltd may purchase such incidental goods and/or services as are reasonably required to perform the services. The cost of obtaining such incidental goods and/or services shall be payable by the Client.
Locator Man Ltd shall maintain records which clearly identify time and expenses incurred.

I agree to the terms & conditions.

1. This agreement governs the provision of cable and other underground locating services by Locator Man Ltd to the person or organisation named on the signed account form.

2. You acknowledge that the services are acquired by you for business purposes only and, to the extent permitted by law, all warranties, guarantees and representations implied by law, trade or custom are expressly excluded.

3. You recognize that Locator Man Ltd are expecting to help you in finding Utilities appeared on plans given by Utility companies. The strategies and equipment utilized in giving the services are not outlined for the reason of recognizing obscure utilities or other unknown underground services, and cannot be depended on for that purpose.

4.Asbuilts and plans provided by the utility companies and councils are an indication only of the location of their underground utilities & structures at the time of installation, and may not have been updated.

5. The accuracy of the procedure and equipment used by Locator Man Ltd can vary. You may not assume that any cable or other underground services lies in the position indicated by Locator Man Ltd. In addition, the equipment and procedure do not provide a reliable guide as to the depth of any cable or other underground services.

6. You must therefore visually confirm the position and depth of all cables and other underground services by carefully hand digging or hydro excavating prior to any excavational works or directional drilling.

7. Locator Man Ltd will not be held liable for any damage to or disturbance to any utilities or structures or for any injury, loss or other consequences of such damage or disturbance, including (without limitation) for loss of use, data, production, profit, revenue, business, contract or anticipated saving, damage to goodwill, reputation or share price, loss of customer or customer losses, loss by reason of full or partial shutdown or non-operation, or for any delay, financing costs or increase in operating costs or any economic loss or for any special, indirect or consequential loss or damage which may be suffered by you, or by any other person or organisation including (without limitation) any operator, owner, customer, service company, or subscriber, You will at all times indemnify Locator Man Ltd against any liability for any such injury, loss or damage, and for all consequences thereof.

8. Without prejudice to the above provision, if Locator Man Ltd should in any circumstances have any liability to you in tort, contract or otherwise in connection with the services, its liability shall be confined to damages in a maximum sum not exceeding the moneys actually paid to Locator Man Ltd by you for the services.

9. The above protections and indemnities also apply for the benefit of all employees, officers, agents and contractors of Locator Man Ltd.

10. You acknowledge that this document contains the entire agreement between you and Locator Man Ltd, and that no representation, warranty or other stipulation inconsistent with this document is expressed or implied on the part of Locator Man Ltd.

What regions do cover?

We are an Auckland based company; however we travel to Northland, North Waikato and Thames-Coromandel area.

What is the cost of locating services?

No site is the same unfortunately. Example to find the power, fibre, gas and water for a residential property can be a very quick job, however there are lot of variables that can cause it to take longer. If the fibre installer did not connect the tracer or your gas pipe does not have a tracer cable with it, it slows the process down. We then must explore other options. Please contact Locator man for the hourly rate or an estimate.

What services can you locate?

We can locate Power, Communication lines, Gas, Water, Stormwater and Sewer. We do however always recommend that you get CCTV for stormwater and sewer. We can locate a variety of other things, but there are always limitations to what we can or cannot do. Please call Locator Man to discuss your scope in more detail.

If I get a service locate and then damage a service, is the liability on Locator Man and I am free of responsibility?

Unfortunately no, it is important that you remember that all liability goes on the individual or company breaking ground, not on the landowner or Locator Man. Although we use excellent calibrated approved tools, all markings put down by Locator Man Ltd should be used as a guide to find underground services only, and no warranty as to accuracy is given or implied.

It is the responsibility of the individual or company that breaks ground to carefully expose and visually see the services before work commences.

In conjunction with location devices and plans, trial holes by careful hand excavation are essential before any excavation is commenced. Hand digging must continue until all of the services have been found. If there is any doubt as to where the service is located, stop work and consult with the service owner.
